Japan’s new draft on the revision of special stay permit guidelines for people with no residential status

The Japanese Ministry of Justice has recently established a draft on the revision of special stay permit guidelines for foreign nationals who have been illegally residing in the country. The revision proposal was compiled in response to comments from the ruling and opposition parties that the rules for when special stay permission can be granted are unclear, in which the Justice Minister granted permission. 


More specifically, people with no residential status may be given permission to stay if the parents have integrated themselves into the community and their children have been receiving education in Japan for an extended period. Additionally, those who entered Japan with a legitimate status of residence and had been active in the community for a long period of time may also be able to continue residing in the country even after their status of residence expires. 

 

On the other hand, those who have gone missing while on provisional release after being detained in a national facility or those who have stayed illegally for an extended period of time will not be considered for the special stay permit.
